The Minutes of the Meeting held on Wednesday 28th March 2007 at 7.30pm
in Winkleigh Community Centre

Present: Cllrs King, J.Turner, Bowers, Leahy, de Louvois, Griffiths, Camilleri & Hodgson

Apologies: Cllrs Stutt, Cowle & N.Turner

Cllr King took the Chair and opened the meeting. The minutes of the meeting held on 28th February 2007 were confirmed and signed as a correct record.
1.3.7 REPORTS
Parish Plan: Cllrs were advised that a meeting of the steering group and other interested parties had been arranged for Wednesday 4th April, 7.30pm in the Community Centre

Affordable Housing: Cllr Bowers informed Cllrs that notices were now placed around the village advertising the affordable housing scheme for Redrow homes development.

Footpath no 22: The Clerk informed Cllrs that she had been contacted by Mr Butler of Kinglsey Cabins in connection with the work to Footpath No22 advising that an agreement had been made between Kingsley Cabins and the Landowner that work would be addressed by 1st May 2007. Cllr De Louvois responded and asked for it to be minuted that he believed that Winkleigh Parish Council were being given "the run-around" and that this issue had been outstanding for some months now. Cllrs were also advised of a letter received from a resident complaining that the works to the footpath had not yet been addressed. Cllr de Louvois proposed that the Parish Council send a forceful letter to Kingsley Cabins stating that should this work not be addressed by the dates given the Parish Council will seek legal advise- 2nd Cllr Griffiths: voting 5 for, 0 against, 2 abstentions (Cllrs Hodgson & J.Turner): MOTION CARRIED.

Sewerage: Cllrs were reminded of the details for the site visit to Winkleigh Sewerage Treatment Works on 29th March 2007.

NatWest: Cllrs were advised that from 26th March NatWest mobile bank will visit Winkleigh Square each Thursday 9.30-10.15

2.3.7 POLICE
WPC Middleton attended the meeting and gave an update on police issues for the community. Cllr Bowers raised that she had had further complaints about the light from the Harris's farm. WPC Middleton advised that she had visited and that they had agreed to address. Cllrs instructed the Clerk to write requesting that the outside light problem is addressed.
3.3.7 COUNTY CLLR JOHN RAWLINSON

Cllr Rawlinson addressed the Parish Council giving them an update on DCC's recent activities in relation to Winkleigh:

Highways: Cllrs were informed that the road from Winkleigh to Morchard Road has been inspected . It had been confirmed that the white lines were in need of refurbishment and that this will be actioned once the winter is over.

Minor roads: Cllrs were informed that some funding has now been made available and that patching will take place this year with a full programme of surface dressing to take place in 2008/9.

Footpath to Sports Centre: Cllrs were informed that the footpath has now been designed and that should funding be available in 2007/8 it would be addressed if not 2008/9.

Clifford's Way: Cllrs were informed of Cllr Rawlinson's involvement and advised that work continues on this project.

Disabled Access: Cllrs were informed that funding has been made available for the dropping of kerbs for Disabled access.

Pre-School: Cllrs were informed that the relocation is on DCC's priority list for Capital Funding. DCC will make a site visit next week.

Travellers: Cllr Rawlinson informed Cllrs that there has been some suggestion that travellers be relocted to the DCC compound on Winkleigh Airfield but that this move has been strongly resisted by Cllr Rawlinson. Cllr Rawlinson advised Winkleigh to be vigilant about this site and the prospect of future allocation for travellers. Cllr Rawlinson also informed Cllrs of Paul Camilleri's independent suggestion of allowing him to site his mobile office on the DCC compound to allow monitoring of this area.

County Locality Budget: Cllr Rawlinson acknowledged the PC's request to use this funding to support the project underway by Winkleigh Youth Club stating that he should be able to match the PC's pledge of £1,000.

Community Centre: Cllr Rawlinson stated that currently DCC and CCOWS are still under negotiations. Cllr Hodgson advised that CCOWS were unhappy with the offer of a 3 year lease to allow opportunity to fund raise as this time frame does nt give them security of tenure and therefore funding opportunities are limited.

Following Cllr Rawlinson's update there were a number of questions raised by Cllrs which were addressed.

Public Period
Reference was made to Winkleigh PC's increase of 27.2% on the Council Tax for 2007/8. It was stated that at the meeting when the precept was agreed it was stated that a letter would be issued in D.W. explaining the increase and that this as not done. It was further suggested that this information be posted on the notice-boards.

Parking on Exeter Road opposite Mid Devon Motors was also raised. Cllrs were advised that WPC Middleton had suggested the implementation of Yellow Lines.

A query was raised regarding the approved occupancy conditions for the log cabins at "The Orchards" following advertisement of the availability of the cabins.

4.3.7 PLANNING

A) Returned from TDC

a) 1/2690/2006/FUL: New double garage (in place of existing outbuilding) and new vehicular access, Townsend Farm, Winkleigh : REFUSED
b) 1/0031/2007/FUL: Single Storey extension, Barn Owls, Punchardon, Winkleigh: APPROVED

B) New Applications
a) 1/0236/2007/FUL: Erect conservatory to rear, 11 Kings Meadow Drive, Winkleigh : APPROVED (all in favour )

b) 1/0289/2007/FUL: Two storey extension, 28 Westcotts Drive, Winkleigh: Cllr Hodgson stated that as in previous applications for extensions on "The Meadows" he believed that originally this estate was designed to capacity and therefore increasing individual properties would increase the density. Following discussions Cllr Hodgson proposed that this application be refused on the grounds of increased density - 2nd Cllr De Louvois: voting 6 for, 0 against, 1 abstention ( Cllr Griffiths): MOTION CARRIED: REFUSED.

5.3.7. FINANCE

c) Notification of any financial information
Councillors were advised that the 2007/8 rates for the Cemetery would be £359.64 per annum paid via direct debit in 2 instalments (April & October)

6.3.7. CURRENT BUSINESS MATTERS

a) Discussions following Guest Speaker
Cllr Hodgson proposed that a letter be sent to Cty Cllr Rawlinson thanking him for attending the PC meeting and accepting his offer to match the Parish Council's pledge of £1,000 towards Winkleigh Youth Club's proposals : 2nd Cllr Bowers: all in favour: MOTION CARRIED.

b) Clifford's Way
Cllrs further discussed the ongoing concerns about the disabled access onto Clifford's Way including statements made by Cllr Rawlinson. Following discussions the Chairman agreed to organise photographs to be taken and forwarded to the Clerk for sending on to DCC Highways.

c) Priorities List
Cllrs had al been issued a copy of the list of outstanding business. The Chairman stated that serious consideration needed to be given to this list by the new Council.

d) Parish Plan/Land Use
The Chairman informed Cllrs that a meeting had been called for members of the steering group, parish Councillors and other interested parties for Wednesday 4th April 2007 and that Dawn Eckhart of CCD will be in attendance.

The Chairman further advised that she had been to a meeting and been informed that Vanessa Sanders (TDC) will arrange a meeting with the new Council on May 9th. Cllrs were advised that Malcom Harris and a representative from the Planning department will attend a meeting with the Parish Council in Winkleigh to address the issues of the Local Plan / Local Development Framework. This meeting will also cover specific discussions on Gerrydown Business Park.

e) Shute Lane
Cllr Bowers informed Cllrs that she was investigating funding for this project. Cllr Hodgson discussed the particular issues of Shute Lane stating that it should be investigated fully prior to any action being taken. Cllr De Louvois queried the possibility of registering Shute Lane as a public footpath. It was agreed that further investigations need to take place. Moved to next meeting.

f) Dog Bins
The Clerk gave an update on this item advising that she was waiting for a detailed response to complaints from TDC for Cllr Bowers to use when she visits the resident who has complained about the location of the dog waste bin at Hollocombe. A letter received from a resident in connection with the provision of dog waste bins was read to Council. Cllr Leahy responded that the Parish Council had fully debated and agreed to supply dog bins and that when responding to the letter it should be mentioned that there is considerable cost to the community of the special collection of litter bins that are full of dog waste.
The Clerk further advised Cllrs that she had been approached by the owners of Londis who have informed her that they have had to remove their litter bin from outside their shop as people are using it for dog waste. Cllrs were advised that they have budgeted for 4 dog bins and have allocated 3 locations so far. Cllrs agreed to wait until the usage etc of the 3 locations is established and then look at the best possible location for the fourth bin.

g) Cemetery Bungalow Sewerage
Cllr Hodgson addressed the Parish Council and gave an update of the situation with the sewerage provision for the Cemetery Bungalow. Cllr Hodgson stated that there is no overspill, smell or evidence of contamination and therefore the existing septic tank is not believed to be polluting. There is however a major problem with the pipe-work from the cemetery bungalow to the septic tank. Cllr Hodgson said that he did not believe the Parish Council were in the position to provide a detailed specification of works required and further proposed that the Parish Council contact Contractors requesting a quote for the design and building of a pipe-work system from the cemetery bungalow to the existing septic tank - 2nd Cllr Camilleri - ( Cllr Leahy abstained from the vote) : All in favour: MOTION CARRIED.
Cllr Hodgson brought to the PC's attention that some months ago SWEB were reported to have been in the Cemetery Grounds reinstalling an earth cable and mole draining without the Parish Council's knowledge. This he said should be investigated because it is entirely possible that this work may have in some way effected the pipe-work for the bungalow sewerage. Further investigations to take place.

PUBLIC PERIOD II
Concern was raised over the number of times during the meeting the Parish Council were informed that they were waiting for a response/decision or further information from DCC or TDC.
7.3.7. LATE ITEMS AT THE CHAIRMAN'S DISCRETION

1) The Chairman referred to comments from the earlier Public Discussion Period in connection with the occupancy conditions for the log cabins at "The Orchards" advising that Cllr Bowers had contacted the Clerk prior to the PC meeting. The Clerk gave an update from TDC stating that permission was given for holiday use only. Cllrs discussed at length following which Cllr Bowers proposed that the PC write to TDC stating that they don't understand what his happening sending a copy of the advertisements for "main residencies" and requesting written confirmation of the approval for HOLIDAY units only . Specifically a request for a copy of the license detailing how many months occupancy is acceptable should be made - 2nd Cllr Hodgson all in favour: MOTION CARRIED.

2) Cllr Hogson advised that as from 1st July the non smoking ban comes into force. It is a legal requirement for owners of buildings to ensure that signs are put up. Cllr Hodgson will organise the supply for the PC.

8.3.7. LETTERS AND CORRESPONDENCE.

1) Letter received from resident in connection with an enforcement issue off Eggesford Road/West of Winkleigh Woods. Clerk to investigate and respond.
2) Letter received from resident regarding a request to replace the kitchen units at the Cemetery Bungalow and to erect a patio in the garden . Cllrs agreed to proceed with the kitchen units but stated that further details would be need , eg size, width, materials etc, before permission could be granted. Also it was noted that with the prospect of extensive works to the bungalow sewerage works any work to a patio would not be appropriate at this time.


There were a number of magazines and circulars for Cllrs to read.


There being no further matters to discuss the meeting was declared closed at 9.15
