S1.9.4 Public Discussion Period
The Chairman addressed the public regarding participation in the public
discussion period of the meeting.
Ms Mondy stated that she was curious of PPL's intentions in their request
to meet with the PC away from the public and also said that the last
meeting at Lapford had not been professionally run by PPL. The Chairman
responded that this matter was to be discussed during the meeting.
Mr Lausen reported on new information collated by DUST.
Mr Smith alerted Cllrs to recent newspaper articles in the Times.
Ms Daynes queried the PC's legal position regarding impartiality. The
Chairman responded that this matter would be covered during the meeting.
S2.9.4 Matters Arising: Re PPL's Proposals
a) Update on information to date
i) Legal Position: The Chairman reported that further information regarding
the Parish Council's legal position had been sought from the DAPC and
NALC. Specific legal advice is expected in the near future.
ii)Reports: The Chairman advised that SWRDA have approached the PC with
an invitation to meet and discuss the reports commissioned for the WINBEG
proposal. The Chairman reported that this meeting had not yet taken
place as despite indications that SWRDA would have the information required
this was still not available. The Chairman further reported that a meeting
had been agreed with SWRDA and John Burnett MP for 9th September to
which two of the PC Cllrs would attend but that due to the delay in
issuing the reports a new date of 29th September had been agreed.
iii) PPL: The Chairman reported that PPL had contacted the PC again
regarding an invitation to meet outside a PC meeting despite having
received the Chairman's letter explaining the PC's position. The Chairman
said that he was trying to determine the reasons for holding such a
meeting as they appear to want to hand over the reports but the Chairman
said he felt that the PC would need to have see the reports and examined
them before any meeting with PPL.
The Chairman further reported that PPL and the Architects acting on
their behalf have both asked if the reports etc could be issued to the
PC on CD.ROM. Cllrs were advised that the Chairman had responded that
hard copies are essential but that a CD.ROM as an addition resource
would be appropriate. Cllr Hodgson said that he believed that SWRDA
had agreed that the PC would get copies of all the reports and proposed
that all information issued to the PC should be received as printed
versions to be held in Council archives as a permanent record with any
electronic version as additions if appropriate -seconded by Cllr De
Louvois - All in favour.
b) Consultation with the community
The Chairman said that he felt it was essential that the PC have an
agreed approach to community consultation and a format for any programme
of events and that consideration had to be given to how the PC will
establish the views of the whole community.
Cllrs debated at length the timing of an exhibition and public meeting.
Concerns were raised about the reports (EIA, Economic Impact & Biomass
Feedstock) not being available and no indication of when they will be
available. Cllr Bowers said she felt that as the PC do not know when
the planning application will be submitted there may not be enough time
to address the issues concerned if the PC wait to hold an exhibition
. Discussions continued regarding the time constraints of the planning
process and Cllr Hodgson proposed that the PC contact TDC and confirm
verbal information received to date that TDC would allow 16 weeks for
determination the application - seconded by Cllr Bowers - All in favour.
Cllr de Louvois reminded Cllrs that until the planning application is
received legally the PC can not make any decisions . Cllr Hodgson responded
that once the reports are received that PC should investigate and validate
the information further adding that with this information the PC would
be in a better position to respond to the application on its receipt.
Cllr Bowers stated that she believed that PPL had, at a previous meeting,
said that the EIA may not be complete when the planning application
is submitted. Cllr Hodgson proposed that the Parish Council write to
all the agencies involved asking for copies of the reports commissioned
or an update of the status of the report and the expected completion
date requesting a formal response by the end of September - seconded
by Cllr de Louvois - All in favour
Cllrs discussed a format for consultation Cllr Bowers proposed that
an exhibition of the information available to date be held on Saturday
2nd October 2004 to be followed by a public meeting - seconded by Cllr
Hodgson - All in favour. It was agreed that the exhibit would be held
at the Community centre and would need to be manned by Cllrs and available
from 9am until 6pm to be followed by a public meeting at 7.30pm.
Cllr Hodgson stated that further events will depend on the issuing of
the commissioned reports but suggested that following the exhibition
and public meeting on 2nd October once the reports had been received
and full investigation been completed, meetings with the agencies involved
would need to be held to address any queries or questions the PC had
. Cllrs agreed that a further exhibition would be held. This exhibition
would be an opportunity to ensure that the public have access to the
reports and also to appraise the community of the PC's response to the
reports. It was anticipated that a further public meeting would need
to be held at this stage.
Cllr Griffiths stated that the community need to be made aware that
the PC are addressing this issue in full.
The Chairman advised that PPL may approach the PC about their exhibition
and public consultation and asked Cllrs for their comments on this.
Cllr Hodgson said that this matter was not for the PC to be involved
in and that venues etc are available in the Parish further stating that
PPL are welcome to attend any PC meeting to address the Council.
Cllrs debated ways in which the views of the community could be accurately
established including discussions regarding a Parish Poll. The Chairman
advised that a Parish Poll would have to paid for by the PC and advised
Cllrs on the legal standing of a Parish Poll. Cllrs agreed that this
matter needs further consideration and accepted that there are a number
of ways of establishing the wider community views.
c) Invitation from PPL to meet
The Chairman said that this matter had been discussed earlier in the
meeting and required little further consideration. The Chairman clarified
the PC's comments that PPL should continue with their planned programme
of events regarding an exhibition and public meeting and that the PC
would continue with their own programme of events, there would not be
available space for PPL to be involved with the PC's exhibition and
that PPL were welcome to attend any PC meeting to address the Cllrs.
d) Other Agency Involvement
The Chairman stated that this matter had been addressed earlier in a
meeting and that no further consideration was required. The Chairman
reminded Cllrs that a meeting has been arranged with SWRDA and John
Burnett MP to which two representatives of the PC will attend on 29th
September 2004.

S4.9.4 Planning Application
Due to a tight deadline the following application was determined by
the Parish Council .
a. 1/1510/2004/REM Agricultural workers dwelling, East Ashley Farm,
Wembworthy - Cllr Cowle declared an interest and left the meeting. Cllr
J Turner proposed that the application be approved - seconded by Cllr
Camilleri - All in favour APPROVED
